Ivanka Trump is set to enter key testimony in her father's civil case in New York this week.

She is due to testify in New York tomorrow as her father, former President Donald Trump, is currently locked in a non-jury trial brought by New York Attorney General Letitia James. Ivanka was unsuccessful in an attempt to claim she is too busy to testify in the trial and will enter testimony into the court records following her brothers Eric and Donald Jr.

Reports suggest that the once close pair have endured a cooling in their relationship since, even though Ivanka insists she "loves" her father "very much." She has not endorsed his run for president in 2024.

Court proceedings are set to resume at 10am local time tomorrow. So where is Ivanka and why did she try to avoid testifying?

Where is Ivanka?

Ivanka Trump's lawyers said "Ms Trump "who resides in Florida with her three minor children, will suffer undue hardship if a stay is denied and she is required to testify at trial in New York in the middle of a school week, in a case she has already been dismissed from, before her appeal is heard."

Her lawyer, Bennet Moskowitz, told the judge Friday that state lawyers “just don’t have jurisdiction over her.” One of Donald Trump's attorneys, Christopher Kise, maintained that state lawyers “just want another free-for-all on another of President Trump’s children.”

“The idea that somehow Ms. Trump is under the control of the Trump Organization or any of the defendants, her father - anyone who has raised a daughter past the age of 13 knows that they’re not under their control,” Kise said.

James wants the defendants to fork over what she claims is more than $300 million in ill-gotten gains and to be banned from doing business in New York.

Judge Arthur Engoron has already ruled that Trump committed fraud by inflating his financial statements. Furious, Trump has called the case and other legal problems he faces a "witchhunt" and "sham."

New York's lawyers argued that Ivanka Trump was a key participant in some events discussed in the case and remains financially and professionally intertwined with the family business and its leaders. Engoron sided with the state, citing documents showing that Ivanka Trump continued to have ties to some businesses in New York and still owns Manhattan apartments.

During her years at the Trump Organization, Ivanka Trump was involved in negotiating and securing financing for various properties, including a lease and loan for a Washington hotel and loans for Trump’s Doral golf resort near Miami and a Trump-owned hotel and condo skyscraper in Chicago, according to court filings.

According to the New York attorney general's office, Ivanka Trump retained a financial interest in the Trump Organization’s operations even after leaving for the White House, including through an interest in the now-sold Washington hotel.

Previously, Ivanka turned her back on being involved in her dad's 2024 presidential bid. A key part of his previous administration, Ivanka was not present at the announcement of her father's 2024 presidential bid and issued a statement explaining she wanted to "prioritise my young children."

"I love my father very much," she said. "This time around I am choosing to prioritise my young children and the private life we are creating as a family. I do not plan to be involved in politics."

Ivanka, the daughter of Donald and his late ex-wife Ivana, added: "While I will always love and support my father, going forward I will do so outside the political arena. I am grateful to have had the honour of serving the American people and I will always be proud of many of our Administration’s accomplishments."

The couple both served as official advisers to Trump during his presidency, but are said to have had enough of life as cogs in the Washington DC political machine. Ivanka has also said she does not believe the 2020 election was stolen despite the 45th president's repeated false claims. "I respect Attorney General Barr. So I accepted what he was saying," she told the January 6 Committee responsible for investigating the 2021 riots at the Capitol.

A person described as being 'familiar' with Ivanka told CNN: "[Ivanka] would never go back to that life. She knows it’s not something that would serve her or her family at this point."

She had advised her father before she joined his political team during his 2016 political campaign, but another person is reported to have added that Ivanka has been done with the American capital "since the day she left."

The pair had a close working relationship and as Executive Vice President at the Trump Organisation and even acted as a boardroom judge on her father's The Apprentice TV show. In March 2017, she was officially made an advisor to the president and became Director of the Office of Economic Initiatives and Entrepreneurship for the duration of the administration the following month.
