Actor Jamie Foxx is being sued for sexual assault after intoxicatingly inappropriately touching a woman at a rooftop bar eight years ago, it has been reported.

The former Django Unchained star was at Catch NYC & Roof when the alleged incident took place. According to the lawsuit, obtained by TMZ, the plaintiff's friend asked Foxx if he would take a picture with her to which the star responded: "Sure, baby anything for you". She claims he seemed intoxicated at the time. She claims he took more photos and commented, "Wow, you have that supermodel body," "You smell so good" and told her she resembled actress Gabrielle Union.

The former The Burial star then reportedly grabbed her by the arm and pulled her into a back area of the bar where he then allegedly wrapped his hands around her waist and felt up her chest. The plaintiff claimed she pulled away from Foxx and noticed that a security guard at the bar watched what happened between the pair and turned away without interjecting.

According to the documents, the plaintiff said the actor then continued to inappropriately touch her as he put his hand into her bottoms and touched her. The plantiff said that after this, her friend noticed what was happening and ran over and Jamie peeled away.

The plantiff said that due to the "sexual assault, abuse, assault and battery" she needed medical treatment and suffered physical pain as well as emotional distress. She is now in the process of suing the 55-year-old actor as well as Catch NYC & Roof and their employees for both compensatory and punitive damages.

The lawsuit was reported to be filed under New York’s expiring Adult Survivors Act, which has given victims of sexual abuse a one-year window for claims that would normally be barred by time constraints. That window closes after Thanksgiving.
