The mum of Lil Tay has broken her silence after the child rapper was caught up in a sick death hoax. Earlier this month a post on the controversial social media star's Instagram feed she said and her brother had passed away, but the following day it was revealed to be a fake.

The new post on Lil Tay's Instagram is written by a legal firm claiming to act on behalf of Tay's mum, Angela Tian. The Mirror has contacted the legal firm to check the post is legitimate. The post gives details of a custody battle between Lil Tay's parents, referring to child support and parenting. The statement claim's Tay's father has been ordered to pay about $275,000 in child support. Angela has teamed up with attorneys Fraser MacLean and Lorne MacLean, K.C. with Maclean Law based in Vancouver, Canada to present them in the custody battle.

Lil Tay's mother said this step is a huge win for her and Lil Tay. She revealed to TMZ that the ongoing legal battle has put her and her daughter in "a constant state of severe depression".

In addition to asking for $275,000 from Lil Tay's father, Christopher Hope, the family is also asking for him to to pay monthly child support going forward and to provide money for any additional expenses, as Lil Tay is currently only 14 years old.

As for custody and parenting, the statement says Angela is responsible for Lil Tay's day-to-day final decision-making powers in the rappers best interest. Her mother is also in charge of signing all of Lil Tay's contracts. As for residency, the rapper will be living with her mother and she has the freedom to relocate outside of Vancouver if she so chooses.

This statement comes after Christopher's initial request to go to court in 2018, demanding that Lil Tay leave Los Angeles and return to Vancouver in an effort to stop her from creating controversial online content. At the time, her father wanted Lil Tay to find a more "traditional" career path in the entertainment industry, like singing or acting. But now with thes new legal proceedings, Lil Tay's family is working to advance her career.

Angela told TMZ: "I have been financially ruined fighting for my daughter’s rights and freedom which should have never been taken away to begin with. We have won our case in court and my children and I can finally move on from this nightmare. My daughter can pursue and achieve her dreams on her own terms, and we are finally a happy family again, together."

This legal battle follows a shocking death hoax surrounding Lil Tay and her older brother Jason Tian. Lil Tay confirmed that she's "safe and alive" despite a statement allegedly from her family announcing her death. The statement was released on her Instagram account, which has over 3.3 million followers, with a post that shared the family's "unbearable sorrow."

But as heartfelt tributes poured in for the rapper, Lil Tay confirmed to TMZ that she was alive and that her Instagram account was hacked by a "third party." Since the announcement, there has been speculation the statement was written by artificial intelligence and other claims that the rapper had an "alternative motive" for creating her own death hoax.
