Prince Harry has faced a fresh blow as his US immigration papers have been ordered to be handed over to a judge so he can decide whether to make them public.

Judge Carl Nichols told the US Department of Homeland Security (DHS) that its arguments so far to keep them withheld were "insufficiently detailed" for him to make a decision. The justice asked the immigration agency to give him declarations explaining the "particular harm" that would arise from the disclosure of the Duke of Sussex's visa application.

The development came after a hearing at the court in Washington DC, last month, in which Judge Nichols heard from DHS and the Heritage Foundation, which is seeking to release the material. The Foundation is seeking the release of the documents as part of a Freedom of Information request it filed last year.

The Think Tank wants to know if the royal, who lives in California, admitted to using illegal drugs before he was granted entry to live in the US. Usually, anyone who admits to using class A's is denied a visa to the States.

Harry, 39, has been accused of "bragging and encouraging illegal drug use" in his memoir Spare, according to a new court filing. In the book, the father-of-two admitted to using marijuana, cocaine and magic mushrooms.

In his controversial memoir, Harry spoke about his past cocaine use and admitted it "didn't do anything for me". He added: "Marijuana is different, that actually really did help me."

He told how he also experimented with the hallucinogenic Amazonian plant ayahuasca. Previously, the US government denied access to Harry's visa application on the grounds it was private.

In January last year and during his Spare book tour, Harry often spoke about his drug use revealing he first took cocaine at 17 while on a shooting weekend. He also admitted to hallucinating during a celebrity-filled event in California and smoking cannabis after his first date with Meghan.

Visa applicants are asked by US officials: "Have you ever violated any law related to possessing, using, or distributing illegal drugs?" Answering yes means it is likely the applicant will be denied entry.
