Elon Musk is suing OpenAI and its CEO, Sam Altman, over what he says is a betrayal of the ChatGPT maker's founding aims of benefiting humanity rather than pursuing profits.

In a lawsuit filed at San Francisco Superior Court, the billionaire said that when he bankrolled OpenAI's creation, he secured an agreement with Altman and Greg Brockman, the company's president. Musk claimed the deal, which dates back to 2015, was to keep the AI company as a non-profit that would develop technology for the benefit of the public.

The lawsuit states that under its founding agreement, OpenAI would also make its code open to the public instead of walling it off for any private company's gains. However, by embracing a close relationship with Microsoft, OpenAI and its top executives have set that pact "aflame" and are "perverting" the company's mission, Musk, 52, alleges in the lawsuit.

"OpenAI, Inc. has been transformed into a closed-source de facto subsidiary of the largest technology company in the world: Microsoft," the lawsuit filed Thursday says. "Under its new Board, it is not just developing but is actually refining an AGI to maximise profits for Microsoft, rather than for the benefit of humanity."

AGI refers to artificial general intelligence, a general-purpose AI system that can perform just as well as - or even better than - humans in a wide variety of tasks. Musk, worth an estimated £166 billion, is suing over breach of contract, breach of fiduciary duty and unfair business practices.

He also wants an injunction to prevent anyone, including Microsoft, from benefiting from OpenAI's technology. The legal action marks the latest development in a prolonged dispute between former business associates, which has been festering for years.

Following Musk's departure from OpenAI's board of directors in 2018, the company surged ahead as a frontrunner in generative AI technology, culminating in creating ChatGPT - a system adept at generating text and engaging in human-like conversation. The Tesla CEO, proprietor of his own AI venture, xAI, contends that OpenAI isn't adequately addressing the existential threats posed by advanced technology to humanity.

Last month, a malfunction of the artificial intelligence language model in ChatGPT led to concerns that the technology is "sentient". Users have reported the chatbot spouting nonsense and even "Spanglish".

Some Reddit users have warned of "threats" made during conversations. OpenAI, the developers of ChatGPT, confirmed there were some "unexpected" responses from the bot.

Some users wondered if the Chatbot had become 'sentient' as it warned the "AI is in the room" with its users. OpenAI announced they are working on fixing the issue. Screenshots of the strange robot later appeared on Twitter/X, with one showing the bot repeating "Happy listening!" dozens of times.
