A Texas mother who claims she ‘sold’ her son has been indicted on capital murder charges - after her son went missing for a year and she fled to India with her family.

Cindy Rodriguez-Singh, 37, is charged on two counts of capital murder, two counts of injury to a child and one count of abandoning a child without intent to return. Her son Noel, 6, who suffers with mental and physical disabilities, was reported missing on March 20 this year despite being last seen way back in November 2022 in Everman, Texas. Noel is presumed dead.

Investigators were ‘alerted’ to a discarded rug and topsoil underneath a porch which had been recently put down at the rented family home on Wisteria Drive. The alert indicated that human remains were at the spot at some point, but there were no major findings and authorities have been unable to locate the body.

Everyman Chief of Police CW Spencer said police have been working “tirelessly for the past six months” to try and “identify any other potential outcomes for this child”. He added: “All of which have been ruled out, leaving us down to one simple conclusion, that he was murdered.”

Spencer says Rodriguez-Singh was using little Noel to receive government benefits - and he was last seen “unhealthy and malnourished” at the time of his twin siblings’ birth in October 2022. Rodriguez-Singh allegedly said Noel had a “demon in him” and accused him of being “evil” and “possessed”.

Two days after Noel was reported missing, Rodriguez-Singh and Noel’s stepfather, Arshdeep Singh, flew to India with their six other children from Dallas-Fort Worth. Arshdeep Singh also faces charges against him if he is found, Spencer said according to MailOnline.

Noel had not visited a doctor since July 2022, before he missed multiple appointments causing the government to step in with warning letters to let Rodriguez-Singh know that the benefits would end. It is reported that Rodriguez then asked another mother to borrow her child to pose as Noel.

Relatives were aware of Rodriguez-Singh’s neglect of Noel, with one alleging she struck Noel for drinking water - because she didn’t want him to wet his nappy. Others claimed it was common for the mother to refuse her son food and water so she could avoid changing him.

Rodriguez-Singh even allegedly sold Noel to someone at a ‘Fiesta Market’ store, according to the search warrant. But Spencer says there is no evidence supporting this suggestion and they believe the mother claimed she did so to throw investigators off her scent. The mother-of-six did not say when she supposedly sold Noel.

Cantarino Rodriguez, Noel’s uncle, told Everman police he saw his sister abusing Noel. He said he confronted Rodriguez-Singh when she struck Nowl with her car keys because he drank water.

When authorities went to the family home on March 20, Rodriguez-Singh said Noel was with his biological dad in Mexico. While police did not have reason to believe she was lying, the mother then began to avoid them. Spencer has since confirmed there is no record of Noel crossing into Mexico and the biological father claims he has not seen Noel.

After obtaining travel visas, Rodriguez-Singh, Arshdeep Singh and their six other children flew to India via Turkey. Authorities are currently working on extraditing the pair back to the US, Spencer said.

He added: “The last thing I want is to have a six year old boy die at the hands of his mother. That's not what I want, but that's the facts that we're faced with here and that's what we're looking at.”

It is possible to criminally prosecute in the absence of a body, criminal defence attorney Russell Wilson said to NBC. “We're very familiar with autopsies, and those usually provide a wealth of information in the manner and means of how a death occurred. But it doesn't mean you can't proceed on a case without it.”
